Placement/service determination is the process of determining what is an appropriate educational setting for your disabled child (e.g., special day class or mainstream, private or public school, home schooling) and what services should the school district provide (e.g., physical therapy, occupational therapy, speech & language, ABA , one to one aide). Quite often, in order to have a school district provide an appropriate education, an attorney negotiates with the school district; that may be done though a demand letter or at an IEP meeting. If the school district is not cooperative; then we sometimes need to litigate against the District, by filing a written complaint with the California Office of Administrative Hearings - Special Education Division.
Limited Conservatorship of Special Needs Adult
When a disabled child becomes 18 years of age, the law views the 18 year old as being able to make his or her own decisions. However, this is not a practical situation with many disabled children. Fortunately, California law has developed a specific form of a conservatorship to address the unique needs of disabled adults; this is referred to as a “limited conservatorship.” We can assist you in obtaining a limited conservatorship on behalf of your child.
Family Law
As part of our practice, we offer legal services in the area of marriage dissolution (divorce), child custody/visitation as well as spousal and child support. As a result of our expertise working with special needs children, we are able to effectively address the unique custody and support issues related to children with disabilities.
